New home for UBC Rugby ? UBC Public Affairs

Athletes and fans will enjoy the new home of University of British Columbia rugby teams at the $2.5 million Gerald McGavin Rugby Pavilion, announced today by Department of Athletics and Recreation and set to open in October 2012.

Located near West 16th and East Mall on UBC?s Point Grey campus and overlooking the Arthur Lord and Frank Buck fields, the Pavilion will feature change rooms, offices, storage space, and bleacher seating for 300 spectators.

The Gerald McGavin Rugby Pavilion will benefit rugby, high performance sport and social life on campus with the addition of a much-needed clubhouse lounge for alumni, students and sport groups.

?Having this facility will showcase our sport,? says UBC men?s rugby general manager Spence McTavish.? ?More importantly, it will bring alumni and rugby fans together.?

The facility is named in honour of UBC Commerce alumnus (?60) Gerald McGavin, a member of the BC Rugby Hall of Fame who generously donated $800,000 towards the project.

?Some of my fondest memories from my athletic career come from playing rugby,? says McGavin.? ?I learned what it takes to work as a team, the value of sportsmanship, and at the same time, I forged relationships that lasted a lifetime.?This facility is the opportunity for the next generation of rugby players to do the same.?

The UBC Thunderbirds women?s rugby team kicks off its season on September 21, 2012 at UBC?s Wolfson Field. The men?s rugby season begins September 15, 2012.

Gerald McGavin is the Director and President of McGavin Properties Ltd., a Member of the Order of Canada, a Fellow of the Institute of Chartered Accountants and the Trust Companies Institute of Canada.? He has received the Montblanc de la Culture Arts Patronage Award for Canada, the Lifetime Achievement Award from the Institute of Chartered Accountants of BC, and the Queen?s Golden Jubilee Medal.

Initial financial and organizational leadership for the project is being provided by former UBC rugby players Peter Bull, Andrew Hamilton, Greg Obertas, Keith Spencer, Peter R. Mortifee, Donald Carson and family, Rob McCarthy and Andrew Bibby.

Funding for the Gerald McGavin Rugby Pavillion includes:

  • $1.6 million from private donors as part of UBC?s start an evolution campaign*
  • $700,000 from UBC Athletics & Recreation
  • $200,000 from the British Columbia Rugby Union as part of a 10-year partnership with UBC.

As an important community partner, the British Columbia Rugby Union will have access to the new pavilion and UBC fields for its youth, developmental, grassroots and high performance programs.

Prostate cancer surgery once again found to be useless at saving lives, but successful at destroying sexual health

(NaturalNews) Most men who undergo surgery for prostate cancer derive absolutely no benefit from the treatment, and instead become twice as likely to develop incontinence or impotence compared to men who skip the surgery. For his study, Dr. Timothy Wilt of the University of Minnesota (UM) School of Medicine evaluated 731 men diagnosed with prostate cancer, some of whom were told to have their prostates removed, and some of whom were told to simply undergo routine observation by their doctors. All the men were tracked and monitored in the years following their initial diagnosis.

10 years after their tumors were first discovered, 5.8 percent of the men who underwent prostate surgery ended up dying, while 8.4 percent of the men who were monitored apart from surgery ended up dying. According to the data, 47 percent of the men who underwent surgery died during the actual study, while 50 percent of the men who were monitored apart from surgery died during the study.

After accounting for a margin of statistical error, the findings reveal that, regardless of whether or not a man diagnosed with prostate cancer undergoes surgery, his chances of dying are roughly the same as if he does nothing. But men who choose to forgo surgery are half as likely to suffer from urinary incontinence or erectile dysfunction.

"We think our results apply to the vast majority of men diagnosed with prostate cancer today," said Dr. Wilt to the Chicago Tribune. He and others in the field of oncology are realizing that most men who receive prostate cancer surgery do not need it, and that undergoing this treatment could lead to other, often permanent, side effects and complications.

Since the risk of dying from prostate cancer among those diagnosed with the condition is a mere three percent, opting for surgery, as many men do, is more often than not a mistake. Worse, many detected prostate tumors are not even malignant, a fact that, if more widely known, would probably deter many men from choosing invasive surgery.

Prevailing thoughts about cancer; however, seem to often override logical consideration and decision-making, as many men rush in to "do something" without fully evaluating the risks and benefits. This is also true in regards to the prostate cancer screenings, which have similarly been shown to be unreliable, and to often result in needless surgery and other treatments.

In Cyprus, a new generation inherits a conflict

(AP) ? Tell a Greek Cypriot that your next destination is the Turkish city of Istanbul, once the seat of empires, and there's a chance you will be gently chided. "You mean 'Constantinople,'" the conversation partner might say, referring to the former Byzantine capital, which fell to Ottoman armies in 1453.

This allegiance to the past is tinged with defiance, a stubborn refusal to call a place by the name chosen by the inhabitants of a hostile country. But it is more recent civil strife and war, nearly half a century ago, that infuse the psyche of Cyprus, a Mediterranean island favored by vacationers for its sun and beaches.??

In a strange twist, divided Cyprus has taken on a role meant to unify, this month assuming the rotating presidency of the European Union, a six-month stint that gives it a self-promotional platform even as it scrambles for a multi-billion dollar bailout to support its troubled banks. In another quirk of split-screen Cyprus, it is seeking money from oil-rich Russia, an increasingly important friend, in addition to the EU, as it tries to avoid the austerity measures that would likely come with any European aid.

At the heart of these dueling directions lies the "Cyprus problem," as it is blandly known.

Talk of a peace settlement between the island's majority Greek Cypriot community and Turkish Cypriots that would end decades of political uncertainty is giving way to a sense that the problem is, unofficially, the default solution.

"People are simply not interested in any form of power-sharing," said Yiannis Papadakis, a social anthropologist at the University of Cyprus. "There is a strong denial of this reality."

Papadakis said the problem is so consuming that it has sapped will on both sides to debate migration, the environment, women's rights and other important social issues. He questioned whether they can compromise and trust each other if they ever reach a political settlement.

Cyprus, which joined the EU in 2004, split into an internationally recognized, Greek-speaking south and a Turkish-speaking north after a 1974 invasion by Turkey, a reaction to a coup attempt by supporters of union with Greece. Travel restrictions between the two sides have relaxed, but negotiations on security and territory foundered. Only Turkey, whose EU candidacy has stalled partly because of the impasse, recognizes the government in the north.

The result is an island that is not quite a nation, with an identity that is the sum of its shards. When George Andreou became the first Cypriot to climb Mount Everest and held up his nation's flag at the summit in May, it was a reminder of division as well as a symbol of unity.

The flag, designed by a Turkish Cypriot and adopted in 1960 after independence from British rule, shows a map of the whole island and two olive branches, a symbol of peace between communities. But Turkish Cypriots use a flag that is a variation of the star and crescent emblem of Turkey, their patron.

In his rucksack, Andreou, 39, also carried the old flag of his hometown Famagusta, which he and his ethnic Greek family fled ahead of Turkish forces, less than one year after he was born. The climber has never returned to his house in Famagusta, where Turkish Cypriots now live, because he thinks it would help to legitimize Turkish forces based in the northern part of the island.

"It is like I never lived my childhood or I refused to remember," Andreou wrote in an email. "I know from my parents that they had been very difficult years since we left everything behind, hoping we would go back soon. It never happened. Instead, we lived in houses without doors and windows, in tents, in the fields, anywhere just to stay safe and away from war."

Days after Andreou, a banker, returned from the Himalayas, his wife gave birth to their first child, who may grow up to discover the same sour politics. The same goes for the 3-year-old daughter of Ahmet Sozen, a Turkish Cypriot research director at Cyprus 2015, a group that seeks to promote joint understanding.

Sozen said the uncertainty goes back to the 1950s, when his father, now 80 years old, was a police officer in a British administration fighting a Greek Cypriot guerrilla group that sought union with Greece.

While today's stalemate is violence-free, Sozen maintains the ethnic Greek-Turkish divide has a corrosive impact on Cypriot psychology.

"I don't want my little daughter to go through the same thing in her life," said Sozen, who was inspired to become a professor of politics in order to help find a solution, even though his self-described "life mission" sometimes exhausts and frustrates him. Polls by his group indicate that Turkish Cypriots, who have leaned toward living apart because of fears of being dominated, and Greek Cypriots, who have tended to prefer a one-state island dominated by their majority, are moving further from the compromise of a power-sharing federation.

Greek Cypriots fear encroachment from Turkey, a rising power that objects to Greek Cypriot plans for off-shore oil and gas exploration. They highlight past suffering, but gloss over the question of 1960s attacks on Turkish Cypriots. Turkish Cypriots resent the Greek Cypriot rejection of unification in a 2004 referendum.

"As more time passes, it's not good for the result, meaning that people are not moving toward the solution spirit. On the contrary," said Sozen, noting that the problem is exacerbated by a gap between Cypriots and their leaders. "People are alienated in the sense that the common people are shut away from the official process. The general public is not really informed by what is happening."

In February, Turkish Cypriot leader Dervis Eroglu said negotiations with the Greek Cypriot leader left "a zucchini taste in the mouth," a Turkish way of saying they have grown bland.

His Greek Cypriot counterpart, President Demetris Christofias said in May that talking to Eroglu was like trying to knock down a wall by throwing eggs at it.

UK's energy policy 'unworkable'

MPs have accused the Treasury of making the government's clean energy revolution unworkable and creating the risk of higher household bills.

They said Treasury changes to the draft Energy Bill will increase the risk of borrowing for investors.

They added that it would put up the cost of renewable and nuclear power, with customers bearing the extra cost.

A Treasury spokesman said the aim was to achieve government goals while protecting businesses and consumers.

Tim Yeo, chairman of the energy and climate change select committee, said: "The Treasury has clearly intervened in the draft bill in a way that will put up bills to consumers and put off investors by increasing their risks.

"This is exactly the opposite of what the Treasury says it wants," he told BBC News.

It is the latest in a series of exchanges between the committee and the Treasury.

Mr Yeo recently criticised Chancellor George Osborne for, in his view, trying to undercut subsidies to onshore wind - the cheapest option of expanding the UK's renewable energy portfolio.

Policy worries

The MPs wanted Treasury ministers to answer questions about their influence on energy strategy, but they declined.

A Treasury source said it would be inappropriate for ministers to be questioned at this stage in parliamentary proceedings.

The committee has two major worries about the finance department's impact on the draft bill.

The first is about the long-term contracts for developers who are being asked by the government to plough billions in the UK's low-carbon infrastructure.

Originally, the Department of Energy and Climate Change (Decc) said the government would guarantee the contracts, thereby reducing the risk for investors and allowing them to borrow large amounts at a low rate of interest.

But the Treasury has since ruled that the government will not be the guarantor.

"This will result in higher borrowing costs, and make banks less likely to make loans," observed Mr Yeo. "It makes no sense."

Jerome Guillet, from Green Giraffe Energy Bankers - an international advisory firm - said: "The government keeps trying to come up with complicated ways of disguising the fact that it's subsidising nuclear and renewables.

"In fact it is continuing to subsidise them but the complications are making the financing more and more expensive," he told BBC News.

Does the cap fit?

The MPs' second worry is over the ongoing consumer subsidy to renewable and nuclear power generators, which are needed for the UK to meet its legally binding targets.

The Treasury says the subsidy will be limited to hold down the cost to consumers - but it won't reveal the size of the future cap.

"This is another thing that's putting up the risk for investors and increasing the cost of energy projects," said Mr Yeo.

"This is really counter-productive. How can investors be confident in planning long-term projects which will rely on price support if the government might turn round and say 'sorry, the cash has run out'. This is another perverse effect."

Mr Yeo is also fighting Treasury attempts to impose big cuts in subsidies to onshore wind farms.

'Don't like turbines'

"The chancellor is being urged by backbenchers to make major cuts to the support for onshore wind. That would cause serious damage to the industry.

"This is another thing that will have a perverse effect because onshore wind is the cheapest way of meeting our renewables targets," he said.

"Under the guise of reducing bills for consumers, the chancellor will actually be increasing consumers' bills.

"I don't know if the back-benchers realise this but surely the Treasury does - yet it keeps pressing on with an action that's clearly political to assuage MPs who don't like turbines in the countryside."

A Treasury spokesman said: "We have conversations will all departments because of the nature of what Treasury does - but we don't answer questions about other departments' policies," he said.

He also pointed out that the Treasury had introduced the controversial carbon price floor to push up the cost of fossil fuel generation, with the aim of making alternative low-carbon energy sources more attractive economically.

CBI director-general John Cridland said major energy investments were "hanging on critical decisions" that the government had to take.

"If they are to plan long-term investments, businesses need to know what the electricity market will look like in years to come," he said.

Tough Times for Franchising | Black People In Business - World Wide

Two closely watched disputes now playing out in the courts are shining a spotlight on tensions between franchise owners and management.

The growing rift between franchisees and franchisers?businesses that collectively employ roughly eight million people in the U.S.?follows three consecutive years of declines in the number of U.S. franchises, and as economic pressures prompt people to limit discretionary spending.

Growing numbers of franchise owners are forming associations hoping to tilt the balance of power away from management. Sarah Needleman has details on Lunch Break.

Late last month, an association made up of roughly 185 U.S. franchise owners filed a lawsuit against Cold Stone Creamery Inc., a subsidiary of Kahala Corp.,

accusing the ice-cream chain of refusing to provide detailed information about funds that the franchisees believe should be set aside for their benefit in a marketing fund.

The lawsuit, which seeks declaratory relief, is asking the court to force Cold Stone to provide the franchisees with information on how much of the rebate money it receives from its approved vendors is actually used for marketing purposes. The Cold Stone franchisee association is also demanding insight into what the company does with revenue and interest generated from sales of unused gift cards.

?We?re paying too much for our products and we?re making less profit every year,? said Frank Caperino, who is part of the association that filed the lawsuit in Miami-Dade County, Fla., state court. Mr. Caperino currently owns two Cold Stone Creamery stores, both in San Diego, which he would like to sell.

A spokeswoman for Kahala, whose other franchise brands include Blimpie sandwiches and Samurai Sam?s Teriyaki Grill, said in an emailed statement that company policy prevented her from commenting on ?pending legal matters.?

Management?s response to the group?s lawsuit hasn?t yet been filed. ?We are confident with our position,? she said.

Cold Stone Creamery, of Scottsdale, Ariz., has roughly 1,500 locations in 17 countries.

A typical Cold Stone Creamery franchise posted $352,000 in revenue in 2011, down from $400,000 in 2005, according to the group of franchise owners who filed the lawsuit. It is difficult to know how much of the declining profitability for franchise owners may be due to the economic downturn, or what the group says is management?s poor decision making.

At least a dozen new franchisee associations have risen out of conflict in the past year, according to several attorneys who helped these associations to incorporate. They are ?forming at a faster rate than ever before? and ?they?re taking a more aggressive and more vocal stance,? says Robert Zarco, the Miami attorney who is representing the Cold Stone franchisee group.

?At the end of the day, it just boils down to profitability,? said Eric Stites, managing director of Franchise Business Review, a market-research company in Portsmouth, N.H. ?When franchisees aren?t making money, that?s when you see them form associations and sue the franchiser.?

Franchisees Versus Franchiser

An association of Cold Stone Creamery Inc. franchisees filed this complaint in a Florida state court last month against the Scottsdale, Ariz.-based chain.

The food sector was hit particularly hard during the recession, as many people cut back on eating out. On average, food franchisees make a profit of $88,382 annually and pay an initial investment of $450,000, according to Franchise Business Review.

Specialty chains like Cold Stone Creamery may have suffered more than other chains, Mr. Stites said. Trade publication Franchise Times estimates that Cold Stone?s systemwide revenue fell 1.1% to $493 million in 2011 from 2010.

The Kahala spokeswoman declined to provide specifics on the profitability of the typical franchisee or the figures provided by third parties.

Franchisees typically sign lengthy agreements that require them to follow the rules of the franchiser, which commonly require arbitration to resolve a dispute, thus restricting their ability to file individual lawsuits.

?Litigation sends a signal to the franchiser and others that something is wrong,? said John Gordon, an independent chain-restaurant analyst in San Diego who served as an expert consultant on a Burger King case.

In that case, in November 2009, Burger King Corp. franchisees sued the fast-food company, claiming that it acted in bad faith when it mandated that its double cheeseburgers be sold for just $1. A settlement was reached last April. As part of the settlement, Burger King agreed to come up with a new systemwide policy for making decisions about what is listed on its value menu.

In September 2010, a group of Edible Arrangements franchisees filed a lawsuit against Edible Arrangements International Inc., claiming management ?abused its discretionary authority? when the fruit-basket chain operator mandated in March 2010 that all U.S. locations must be open on Sundays and stay open for an additional two hours every other day of the week. The decision was made ?with little to no regard for the individual needs or surrounding demographics of its franchisees,? according to the complaint filed in the U.S. District Court for the District of Connecticut.

?Our franchise agreement is illusory,? said Sherri Vertorano, an Edible Arrangements franchisee in Mooresville, N.C., who is part of the lawsuit. ?It?s like a living, breathing document that changes whenever the franchiser wants to create another revenue stream.?

Ms. Vertorano and about 200 other franchisees are also seeking to stop Edible Arrangements management from collecting 2% of gross sales on orders placed over the Internet, among other grievances, according to the complaint. That fee was implemented last month, the company said.

Tom Downes, owner of an Edible Arrangements outlet in Portsmouth, N.H., said he is frustrated with the requirement that his business maintain Sunday hours. The 53-year-old said he averages about $1,000 in sales on weekdays but on a recent Sunday he made $23.

Tariq Farid, president of Edible Arrangements, denied the allegations in the lawsuit and said any new operating procedures the company implements are intended to benefit its franchisees, not hurt them.

Mr. Farid, who founded the company in 1999 and began franchising it in 2001, declined to provide specifics on the profitability of the typical franchisee. The Wallingford, Conn.-based company has more than 1,000 outlets, and posted $425 million in systemwide revenue last year, up from $380 million in 2010.

Management has been investing more in social media and ecommerce, for instance, to help the franchise owners keep up with current consumer taste. ?At the end of the day, if you deliver results, they?ll respect you,? Mr. Farid said of franchisees.

FC Dallas was at the very edge of something quite special; manager laments choice of late PK taker:

FC Dallas was at the very edge of something quite special.

Despite still missing three of its top starters ? striker Blas Perez and center backs Ugo Ihemelu and George John ? the club had just rallied from two goals down, on the road and against the league?s top side, no less. An 89th-minute strike left Dallas trailing, 2-1.

About two minutes later, Zach Loyd earned a dramatic stoppage-time penalty kick for the visitors. So Dallas was this close to pulling off something truly memorable. Having won on the road four nights earlier, and with the bottom team in the West coming to Texas this weekend, Dallas had the chance to string together a trio of results that can build real confidence (and make up some serious ground in the playoff chase).

Then Jair Benitez happened.

It was Dallas left back who stepped up to take the critical penalty kick. Brek Shea had been subbed out. So had David Ferreira.

So up stepped Benitez, a man without a goal in 83 MLS matches. He sent the ball well into the San Jose night. The Earthquakes survived. But will FC Dallas? spirits do the same after such a dreadful turn?

Here?s what Hyndman said about the choice:

Unfortunately, Brek [Shea] is the one who normally takes our PKs and we subbed him out. [David] Ferriera is another one that has taken PKs and [Daniel] Hernandez is another one that has taken PKs. So we were looking at potentially three different players and the question became who can do it. In hindsight, we probably should have went with one of the other two.?

Here?s the thing with Benitez: He just keeps costing FC Dallas points. Again and again. Whether it?s due to bad defending, taking sill fouls or leaving his team a man down because he selfishly lashes out, he?s been costing the team points for two years.

Why he?s still on the field, only Hyndman could say.

The 33-year-old Colombian was once an offensive force from the left back spot. Determined attacking tenacity from the left back spot helped Dallas keep teams pinned in.

But that was 2010, when FCD advanced to the MLS Cup final. He simply isn?t that player anymore. Benitez has no assists in 15 contests this year ? and the defensive errors continue to compound.

Officials say NFL planned lockout

NEW YORK (AP) ? The NFL's on-field officials say the league is paying lip service to player safety by contacting replacement officials.

They also believe the NFL planned to lock them out rather than negotiate a new contract. Members of the NFL Referees Association were locked out June 3 after talks broke down.

NFLRA President Scott Green and past president Ed Hochuli, both current referees, said Wednesday the NFL is jeopardizing the safety of the players, as well as the integrity of the game, by considering using officials they feel are unqualified. None of those officials will come from the top college division because they all are barred from accepting NFL jobs by the colleges, Green said.

"To take seven officials who have not worked Division I (college) games or not worked the last several years," he said, "and to put them on the field has got to be pretty unsettling not only to the players and coaches, but to the fans.

"The players have plenty of things to worry about on the field, they don't need to be worrying about the officials."

Green said players know the current officials are consistent in their calls, but won't have any idea "what will be called or seen and what won't be, and that will be a product of how the game is being affected."

Added Hochuli: "There is no game if the competitive nature of the game is not being controlled" by officials.

The NFL disagreed, saying in a statement:

"Our goal is to maintain the highest quality of officiating for our teams, players, and fans, including proper enforcement of the playing rules and efficient management of our games.

"We are confident that these game officials will enforce rules relating to player safety. Contrary to NFLRA leadership, we do not believe that players will 'play dirty' or intentionally break the rules."

Dr. Thom Mayer, the NFL Players Association's medical director, met Tuesday with the officials to discuss their situation and its potential impact on the players' safety.

"I don't know how to look at the type of officials they are talking about using and not raise the issue of if there will be health and safety issues," Mayer told The Associated Press on Wednesday. "We will be monitoring that closely during the preseason."

Hochuli, perhaps the best-known NFL ref, said the 121 officials who are locked out are training on their own, including hours of video work and taking rules tests.

"When the lockout ends ? and we know it will end ? we'll be ready to take the field the next day," Hochuli said. "But just like the players, whose preseason helps get the mistakes out before the season starts, if there is no preseason (for the officials), there will be mistakes that will happen, just like with the players."

The players were locked out for 4 1/2 months last year before getting a 10-year contract.

"Lockout seems to be their negotiating strategy with everyone," Green said. "We don't want to be locked out. We want to get back to the table and get this resolved."

The league responded that it began the process of hiring replacements when the officials told the NFL of their intention to authorize a strike.

"We have great respect for our officials and in keeping with that view have made a proposal that includes substantial increases in compensation for all game officials," the NFL's statement said. "We have negotiated in good faith since last October. We accepted the union's suggestion that we involve federal mediators in the negotiations.

"We are available to meet with the NFLRA at any time to negotiate a new contract."

No talks are scheduled.

The officials say their wage offer was for a smaller increase than they received in the collective bargaining agreement that expired in May. They said it would cost each of the 32 teams $100,000 per year to meet that proposal.

The NFL has called its offer to the officials a fair one, noting it includes a seven-year deal with annual compensation increases of between 5 and 11 percent. According to the league, an official in his fifth season earned an average of $115,000 in 2011 and would earn more than $183,000 in 2018 under its proposal.

The officials also cite as issues higher wages for their peers in the NBA, NHL and Major League Baseball, and the loss of a pension system established in 1974 and administered by the NFL until it was recently frozen, then eliminated.

"No game official will lose any vested pension benefit under our proposal and the clubs will fully fund all pension obligations," the league said.

The NFL used replacement officials for the opening weekend of the 2001 season. Then came the Sept. 11 terrorist attacks and a new CBA soon was reached.

But many of the officials used 11 years ago had worked at the highest college level, and the NFLRA says the officials being interviewed now aren't nearly as experienced.

"Players know who we are," Hochuli said. "They were kids watching us on TV. There's a certain amount of, 'Hey, I realize Hochuli is watching what I'm doing.' If they've got a high school or junior college official out there, they're going to do more."
